How divorce works:
In Virginia, a divorce can be granted by the request of one or both parties, and can be pursued in one of two ways: 

  • On Fault Grounds
  • On No-Fault Grounds


An experienced family law attorney can help you decide how to handle your divorce. In a no-fault situation, a period of legal separation is required before a divorce may be granted, but neither party has to prove any wrongdoing by the other.

If you decide to pursue a divorce on fault grounds, you (with assistance from your lawyer) must be prepared to show that the other party intentionally abandoned you or treated you badly (in a manner that follows Virginia's legal definition of cruelty.)


Litigation vs. Negotiation
In any divorce, the parties have the option of negotiating an out-of-court settlement. Negotiation is easier in a no-fault situation and may be the preferred approach. The essential element of any successful negotiation is communication. If you are not able to sit down with your soon-to-be ex-spouse and discuss the terms of your divorce, you will not be able to negotiate a settlement.

Litigation can be time-consuming and stressful, but sometimes going to court is the best option in a divorce case. If you are not able to communicate or come to reasonable terms with the other party, litigation is the next option, and may actually be preferable to a negotiation in which neither party will budge. In divorce cases in which there are fault grounds, litigation provides an opportunity to present proof of cruelty or abandonment by the other party, which can influence rulings on custody and property division.

We prepare every case for either option. If at any time you decide to cease negotiation and take your divorce case to court, your lawyer will be prepared to litigate.
