Virginia law draws a firm line between a traffic infraction and a criminal traffic misdemeanor. These aren’t degrees of the same thing; they’re separate legal categories that call for very different responses.
Traffic Infractions & the Prepayment Trap
An ordinary speeding ticket is a traffic infraction. Many drivers prepay the fine before their court date without realizing that prepayment is legally treated as a guilty plea, resulting in a conviction. That conviction adds demerit points to your DMV record, and those points remain valid for two years from the date of the offense. Whether it’s worth contesting depends on how many points you already carry and what the conviction could do to your insurance rate.
Reckless Driving by Speed: A Criminal Charge
Reckless driving is not a traffic infraction. Under Virginia Code § 46.2-862, a driver commits reckless driving by speed by traveling 20 miles per hour or more over the posted limit or by driving in excess of 85 miles per hour regardless of the posted speed limit. A separate provision, Virginia Code § 46.2-852, covers general reckless driving for operating a vehicle in a manner that endangers life, limb, or property.
Either way, reckless driving in Virginia is a Class 1 misdemeanor, the most serious misdemeanor classification. Penalties can include up to 12 months in jail, a fine of up to $2,500, and a license suspension of up to six months, and a conviction can create a criminal record. In the right circumstances, a reckless driving charge can be amended to improper driving, which is a traffic infraction rather than a criminal offense. Whether that outcome is available depends on the specific facts of the case.
How a Traffic Case Moves Through Stafford County Court
Traffic infractions and criminal misdemeanors in Stafford County are heard in the Stafford County General District Court.
